「WPM英語スピーキング」（以下「本アプリ」）のご利用にあたっては、以下の免責事項に同意いただいたものとみなします。

1. サービスの提供

本アプリは「現状のまま」提供されるものであり、明示または黙示を問わず、特定目的への適合性、正確性、完全性、継続性について、いかなる保証も行いません。

2. 学習効果について

本アプリはスピーキング練習を支援するツールであり、特定の学習効果や英語能力の向上を保証するものではありません。学習効果には個人差があります。

3. AI評価の精度

本アプリで利用するAI評価（音声書き起こしに OpenAI Whisper API、評価生成に Google Gemini API を使用）の結果は参考情報であり、その正確性や完全性を保証するものではありません。評価結果を唯一の判断材料とせず、ご自身の判断でご活用ください。

4. 利用者の責任

利用者は、本アプリを以下の事項を遵守のうえ、自己の責任においてご利用いただくものとします。

• 関連する法令および公序良俗を遵守すること
• 第三者の権利（知的財産権、プライバシー権、肖像権等）を侵害しないこと
• アカウント情報（Apple ID等）を適切に管理し、第三者による不正利用を防止すること
• 本アプリの不正利用、リバースエンジニアリング、改変、その他開発者に損害を与える行為を行わないこと
• スピーキング練習において、自身または第三者の個人情報・機密情報（氏名、住所、電話番号、メールアドレス、クレジットカード番号等）を発話しないこと。発話された内容は音声認識によりテキスト化され、AI評価のため外部サービス（Google Gemini API）に送信されます。プレミアム会員のAI評価利用時は、録音音声データそのものも外部サービス（OpenAI Whisper API）に送信されます

利用者が本項に違反して生じた損害（個人情報・機密情報を発話したことによる情報漏えいを含みます）について、開発者は一切の責任を負いません。

5. 損害の免責

本アプリの利用または利用できなかったことに起因して生じた一切の損害（直接損害、間接損害、特別損害、結果的損害、逸失利益等を含みます）について、開発者は一切の責任を負いません。

6. 第三者サービス

本アプリは Firebase、Google Gemini API、OpenAI Whisper API、RevenueCat、Apple 等の第三者サービスを利用しています。これら第三者サービスの停止、障害、仕様変更等により生じた不具合・損害について、開発者は責任を負いません。

7. サービスの変更・中断・終了

開発者は、予告なく本アプリの内容の変更、提供の中断または終了を行うことができるものとし、これにより利用者に生じた損害について一切の責任を負いません。

8. 知的財産権

本アプリに含まれるコンテンツ（テキスト、画像、ロゴ、プログラム等）の著作権その他の知的財産権は、開発者または正当な権利者に帰属します。無断での複製・転載・改変等の利用を禁止します。

9. 免責事項の変更

本免責事項は必要に応じて更新されることがあります。変更があった場合は、本ページを更新してお知らせします。

By using "WPM English Speaking" (the "App"), you agree to the following disclaimer.

1. Service Provision

The App is provided "as is" without any warranties, express or implied, including but not limited to fitness for a particular purpose, accuracy, completeness, or continuity.

2. Learning Outcomes

The App is a tool to support speaking practice and does not guarantee any specific learning outcomes or improvement in English proficiency. Results may vary among individuals.

3. Accuracy of AI Evaluation

The AI evaluation results (via Google Gemini API) provided by the App are for reference only and their accuracy or completeness is not guaranteed. Please do not rely solely on these evaluation results.

4. User Responsibility

Users are responsible for their use of the App and must comply with the following:

• Comply with applicable laws and public order and morals
• Do not infringe on the rights of third parties (including intellectual property rights, privacy rights, and rights of publicity)
• Properly manage account information (such as Apple ID) and prevent unauthorized use by third parties
• Do not engage in unauthorized use, reverse engineering, modification, or any other actions that may cause damage to the developer
• Do not speak your own or any third party's personal or confidential information (names, addresses, phone numbers, email addresses, credit card numbers, etc.) during speaking practice. Spoken content is converted to text via speech recognition and transmitted to an external service (Google Gemini API) for AI evaluation

The developer is not liable for any damages resulting from a user's violation of this section, including information leakage caused by speaking personal or confidential information.

5. Limitation of Liability

The developer shall not be liable for any damages (including direct, indirect, special, consequential, or loss of profits) arising from the use of, or inability to use, the App.

6. Third-Party Services

The App uses third-party services such as Firebase, Google Gemini API, RevenueCat, and Apple. The developer is not responsible for any issues or damages caused by the suspension, failure, or changes in specifications of these third-party services.

7. Changes, Suspension, or Termination of Service

The developer may change, suspend, or terminate the App at any time without notice, and shall not be liable for any damages resulting from such actions.

8. Intellectual Property Rights

Copyrights and other intellectual property rights in the content of the App (text, images, logos, programs, etc.) belong to the developer or rightful owners. Unauthorized reproduction, reprinting, or modification is prohibited.

9. Changes to This Disclaimer

This disclaimer may be updated as necessary. If there are changes, we will notify you by updating this page.
